General terms & conditions

Article 1: Identities Parties

In these conditions , called here ” General Conditions” shall mean:

Purchaser : The party of the Seller in an agreement referred to in Article 3 of these Terms and Conditions

Article 2: Applicability & Validity Conditions

2.1 These General Conditions apply to every offer of Seller , each order of the Buyer and to any agreement entered into between the Seller and the Buyer .

2.2 Before the distance contract is concluded, the text of these Terms made available in such a way that it can be stored on a durable medium.

2.3 The buyer is obliged to accept The General Conditions for the conclusion of the agreement.

Article 3: Offers, Orders & Agreements

3.1 All offers by Seller are binding and can be revoked .

3.2 If any term of outs are subject to availability either the term stated on the website, after exceeding the duration of the offer, the offer lapses by law and the Buyer can no longer make use of the offer.


3.3 Buyer may order in the ways that are described in the service pages .

3.4 Seller can – within the law – to inform the Purchaser or to his / her payment obligations, and of all those facts and factors that are important for the responsible conclusion of the agreement.

3.5 If the Seller has good grounds , the Seller is entitled to refuse an order or impose special conditions in the agreement ..

3.6 The Seller reserves the right to refuse orders :

– If the Seller the residential address of the Buyer is unable to determine ;

– If the order is placed by a person under 18 years ;

3.7 If the Seller does not accept an order, or if the Seller wishes to connect to the agreement, special conditions shall inform the Seller within 7 working days after receipt of the order to the Buyer.


3.8 The agreement is subject to the provisions of Article 3.5 , concluded at the time that the Buyer places an order with the Seller on the basis of the offer of the Seller and the Buyer satisfies the corresponding conditions.

3.9 Seller shall confirm receipt of the order electronically. Until receipt of the order is not confirmed, the Buyer may terminate the contract.

Article 4: Prices, delivery & payments

4.1 The prices of the goods offered in the online shop are in Euros, including VAT and excluding shipping costs unless otherwise stated or agreed .

4.2 The Seller may charge with every order amounting to shipping costs, regardless of the number of items ordered .

4.3 Buyer may pay the ordered products through a medley of payment methods, including credit card and Ideal .

4.4 When paying by credit card Seller reserves the right to verify that the credit card is valid, or sufficient funds for the amortization of the purchase price and whether the address of the Buyer are correct. Seller reserves the right to refuse to purchase by credit card.

4.5 If the Buyer ‘s order delivered to Buyer is in default with the payment of one or more already, the Seller has the right to refuse new orders.


Article 5: Delivery & Risk

5.1 Seller shall exercise the greatest care when receiving orders and when sending the items that are ordered.

5.2 Seller sends the accepted orders as quickly as possible in order of receipt of payment.

5.3 Delivery takes usually takes place within four working days after the order is received no later than 30 days after receipt of the order.

5.4 In case the delivery is delayed, or if an accepted order can not be delivered, within 30 days after placing the order: Purchaser in that case has the right to terminate the contract without cost. In case of dissolution of the Seller, if the Buyer has ordered products that are already paid, the amount received shall be refunded as soon as possible , but no later than two weeks after that dissolution .

5.5 The risk of damage and / or loss of products until the moment of delivery to the Buyer lies by the Seller unless expressly agreed otherwise.

5.6 The delivery of the purchased products takes place at the address specified by the Buyer in the order. If buyer is not at home at the time of delivery, the Seller is entitled to deliver the goods at the neighbors.

Aricle 6: Force Majeure

6.1 Without prejudice to its other rights accurring to the Seller has the right  in the event of force majeure, at its discretion, to suspend the execution of the order or, without judicial intervention, without which the Seller is liable for any compensation unless the agreement in writing this would be unacceptable. In the circumstances to standards of reasonableness and fairness there is, among other case of force majeure, in the event of strikes, illness among staff , disruptions in transportation and import / export bans , whether this occurs at the Seller or the Seller ‘s suppliers.


Article 7: Right of withdrawal upon delivery of products

7.1 The buyer has the right to terminate the agreement within 14 days from the date of receipt of the product / products, without reason.

7.2 During this period, the Purchaser shall handle the goods / products and packaging, and only unpack or use it as needed in order to judge whether he / she wishes to keep the products.

7.3 If the Buyer would make use of his / her right of withdrawal within the period specified in Article 7.1,  buyer must return by using the appropriate return form supplied to the following address  Rain Couture, Huidenstraat 32, 1016 ET, Amsterdam , attn returns department.

7.4 The returned goods must be in original state and must bear the original labels and / or tags . When a product has deteriorated in quality and / or the original labels and / or labels have been removed, the Seller retains the right to take into account the purchase price of the product.

7.5 If the Buyer makes use of his right of withdrawal , the cost of return come to his / her account.

7.6 If the buyer has already paid for the returned goods , Seller shall return this amount within 30 days after return refund to Buyer.


Article 8: Complaints

8.1 All shipments are insured by Seller. If the Purchaser noted damage on the packaging before opening the package , buyer should contact the Seller immediately.

8.2 The buyer has an obligation to investigate whether the products meet the agreement on delivery. If this is not the case, the Buyer , shall contact the Seller as soon as possible and in any event within seven (7 ) days after delivery of the product to the buyer , or after observation reasonably possible to give.

8.3 Minor deviations permissible unavoidable commercially or technically considered in quality, color , size , weight , finish, design , etc. constitute a basis for complaints .

8.4 If it is demonstrated that the products do not conform to the contract , the Seller shall have it replaced by new products or to refund the invoice value.


Article 9:Warranty & Liability

9.1 Information on the quality , composition, application , properties and handling of goods supplied by or on behalf of Seller shall only act as a guarantee if it explicitly and in writing in the form of a guarantee have been confirmed by the Seller.

9.2 If the Buyer during the warranty period without the prior consent of Seller repairs or changes the product, then the warranty expires immediately.

9.3 The Seller’s liability versus the Buyer regarding the non – time and or improper performance is limited to the invoice value of the delivery.


Article 10: Modification of Agreements

10.1 Changes and additions to concluded agreements are only valid if they have been explicitly agreed in writing  between Seller and Buyer.


Article 11: Disputes and Applicable law

11.1 All disputes concerning the products delivered can be submitted to the competent court in the jurisdiction in which Seller is resident or located.

11.2 The agreements and consequent disputes between Buyer and Seller shall be governed by Dutch law.
